Practice Areas | Construction Litigation

The firm handles all aspects of construction litigation, including defect claims, workplace injuries and contractual disputes. Clients include general contractors, all subcontractor trades, developers, architects and engineers. Cases range from single-family homes to large-scale residential developments, from public entity projects to complex commercial projects.

The firm’s lawyers are acutely aware of the importance of insurance issues in construction claims. Our collective knowledge of insurance coverage enhances our ability to pursue the coverage interests of our clients and we do so aggressively, and with confidence and efficiency. We do not believe the concepts of reimbursement, contribution and indemnity are mere legal fictions.
Lawyers at the firm endeavor to apply the fundamental firm policy of claim resolution rather than claim protraction to construction claims. We recognize that construction disputes can be complex and costly, but we firmly believe that costs can be controlled. We do not dispute liability when it is clear, but prefer to engage in damage assessment and expense control. We will not litigate fault issues when we know we will eventually lose those issues and damage our credibility when it comes time to negotiate damages; this practice saves our clients both expense fees and settlement monies.
Several of the firm’s attorneys have worked in the construction trades and are uniquely qualified to evaluate responsibility and damages. The contractors we represent appreciate our ability to understand their concerns and the issues presented. We try not to hire the usual stable of construction experts, preferring instead to use real contractors who give us real bids to do repairs, not litigation bids which we know the opposing sides will never accept. We have settled countless cases for the amounts estimated by our experts, not by the opposition’s.
